served with a Summons and Complaint for Foreclosure, the firm provides comprehensive representation and foreclosure defense. These services

- Filing an Appearance with the court to inform all parties that Hays Firm LLC will be representing the homeowner in the lawsuit and
that all communications should be directed to the firm;
- Filing an Answer in response to the lender’ s Complaint for Foreclosure,
which will include all applicable defenses;
- Filing the necessary document requests with the court in order to force the
lender to turn over all relevant records, such as all documents that
prove the lender is the actual owner of the mortgage, the documents
which establish the basis for the amount that the lender claims is due,
etc.; and
- Analyzing the loan documents to ensure that the lender complied with all relevant
state and federal laws.
In addition to making the lender work to prove that it has a right to
payment, the firm will negotiate with the lender in an attempt to modify the terms of the
loan, reduce the monthly payments and avoid foreclosure.
The firm’s charges a flat fee to perform the above-described
services for a specified period of time, depending on the facts of case.In the event that
the firm’s representation extends beyond the time period covered by
the initial flat fee, the firm will set a monthly fee that will cover the remainder
of the litigation proceedings.
